was pretty clear that for the first time, the president was put on the defensive as far as his record is concerned. and that's because of this bubble he's been in for the last four years and he obviously couldn't defend it. finally, piers, i thought one of the seminal moments in that debate was near the end, when jim lehrer talked about the lack of bipartisanship, the lack of sitting down together and averting this fiscal cliff that most americans know we're headed towards, and mitt talked about being governor of massachusetts, reaching across the aisle, having to negotiate, et cetera. the president's responses, sometimes you have to say no to people. is that, you know, and the fact is first two years, as mitt pointed out, first two years of his presidency, they just rammed things through without a single republican vote. so i think those were -- that makes it probably one of the really more important debates in american history and perhaps i'm exaggerating because i'm so happy. >> i can't blame you. i can't blame any republicans because it's been a very bruising few weeks for

broken. his strategy will be to sort of play defense. not make any mistakes, play it very safe. he's got to stick to the strategy, which is emphasize the positives in the last four years and do what he's been doing, attack romney, attack him on that 47%. the other thing obama has to do, he's done a little bit but he hasn't to a certain degree is lay out specifics for a second term. if you look at the swing voters, they want to know what they're going to do. he's got to do that a little bit more. finally, in previous debates where obama has gotten in trouble, he seemed cocky and overconfident. >> there's a lot of talk about that. he could create trouble for himself if he goes down that road. that comes naturally. how do you overcome that? >> a lot of people have been talking about with hillary clinton when he said you're likeable enough, hillary. that was a similar dynamic. obama was winning the likability race there. he said it almost in an offensive way. he's got to be careful that -- obama doesn't have a lot of respect for mitt romney. >> exactly. does that manifesto owe that's goi

give you a sense, over ten years, that's more than our entire defense budget, and you think that by closing loopholes and deductions for the well to do, somehow you will not end up picking up the tab, then governor romney's plan may work for you. but i think math, common sense, and our history shows that's not a recipe for job growth. look, we've tried this. we've tried both approaches. the approach that governor romney is talking about is the same sales pitch made in 2001 and 2003. and we ended up with the slowest job growth in 50 years. we ended up moving from surplus to deficits, and it all culminated in the worst financial crisis since the great depression. bill clinton coined the approach i'm talking about. created 23 million new jobs, went from deficit to surplus, and businesses did very well. so in some ways we've got some data on which approach is more likely to create jobs and opportunity for americans, and i believe that the economy works best when middle class families are getting tax breaks so they've got money in their pockets, and those of us who have done extraordinar

thing people will be watching for is whether the court takes a case on gay marriage or the defensive marriage act. so a lot on the plate and some very divisive and even wedge issues, the court could be deciding this term, ashleigh. >> and listen, joe, as we've been covering the supreme court for the last 20 years, it's no secret that these decisions become increasingly partisan or at least that is the optics out there for those of us who watch this. because those decisions are always right down the line it seems on the big, big topics. in fact sandra day o'connor recently said in an interview said she's distressed about the confidence level in the country. so with these big decisions coming up, is it important for chief justice john roberts to keep that in mind? to keep this confidence level of the united states front and center as this group makes these decisions? >> well, i think right now despite the health care decision that everybody knows about, you still have to say that chief justice roberts is a conservative. and you're right, this court is very evenly divided, sort of four
